Full Terms and Conditions - DOUBLE THE CHRISTMAS SPIRIT (the “Promotion”)

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the terms and conditions and by participating, all entrants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.

1. Eligibility & Limitations

1.1 This Promotion is open to GB residents only aged 18 and over. Those excluded from the Promotion include employees and the immediate families of the Promoter, its subsidiaries, other group companies, its agents, or anyone else professionally connected with this Promotion.

1.2 The Promotion opens at 00:00 on 01.12.2020 and closes at 23:59 on 20.12.2020 (“Promotional Period”). Internet access required. No purchase necessary.

1.3 Entries are restricted to a maximum of 4 entries throughout the Promotional Period per household.

1.4 Each entrant has one chance to win across entries via Co-op stores and Southern Comfort social media channels. Entrants cannot win twice if entering through both Co-op stores and social media channels.

1.5 One prize per household.

2. Entry Mechanism

2.1 To enter the Promotion visit www.winwithsoutherncomfort.co.uk (also accessible through unique promotional QR code in participating Co-op stores), enter your full name, date of birth, valid email address and postal address (the “Entry Mechanism”).

2.2 Winners of a pair of Christmas bauble glasses will be notified immediately.

3.1 Promotion prize is 1 x pair of Southern Comfort Christmas bauble glasses.

3.2 There are 500 x pairs of Southern Comfort Christmas bauble glasses to be won through Co-op entries

3.4 Prizes will be posted by FedEx to winners to the registered postal address stated upon entry within 5 working days.

4. Winner selection and notification

4.1 During the Promotional Period, Southern Comfort Christmas bauble glasses will be won using a secure and automatic computer-generated algorithm that produces verifiably random results. Each participant’s chance of winning is based on the number of entries vs the number of prizes to be given away at the start of the promotion. The percentage chance of winning will not decrease across the promotional period. The number of prizes won will be (statistically) dependent on participation rates. Wins will be allocated independently by the system using an algorithm. Entrants will find out instantly if they have won a pair of Southern Comfort Christmas bauble glasses once they have submitted their details and entered.

4.2 No entries from agents, third parties or organised groups will be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’ or any other automated means, or using other means to create bulk entries, that person’s entries will be disqualified and any prize award will be void.

5. Limitations

5.1 The Promoter is not responsible or liable for:

1. Any entries that are lost or delayed due to faulty or failed electronic data transmissions.
2. Communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines satellites, servers, computers or providers utilised in any aspect of this Promotion causing delays or disruption.
3. Any claims which are lost, delayed, corrupted, damaged, misdirected or incomplete or cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of delivery.
4. Any loss or damage to property incurred (to the maximum extent permitted by law) as a result of entering into this Promotion or enjoyment of any prize that may result from entering this Promotion.

6. Consent

6.1 Winners agree and give their consent to participate in any reasonable publicity required by the Promoter.

6.2 You acknowledge that Hi-Spirits will handle your personal information, in accordance with the Hi-Spirits privacy policy http://www.sazerac.com/SazeracPrivacyPolicy.html, for legitimate business purposes such as to provide you with personalised services and content, to analyse and consider ways of improving our services and products, and to respond to your requests. All personal data collected as a result of this competition will stored for a maximum of 12 weeks after the closing date by Hi-Spirits, before being deleted in accordance with the GDPR, except for the holiday prize winner, whose data will be deleted after their prize has been fulfilled. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to help@winwithsoutherncomfort.co.uk. By participating in the Promotion, you agree to the use of your personal data as described here.

6.3 The surname and county of the holiday prize winner will be available by sending a stamped self-addressed envelope to: Umbrella, Dodwell House, Chilton Business Centre, Chilton, Bucks HP18 9LS for a period of 12 weeks after the closing date. We reserve the right to refuse any or all such request. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting help@winwithsoutherncomfort.co.ukWe may nevertheless disclose the information to the Advertising Standards Authority if required to do so.

6.4 The Promoter reserves the right to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions, the spirit of the promotion, any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating or won using fraudulent means.

7. Other

7.1 If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries/claims. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.

7.2 The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize/gift, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.

7.3 If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect

7.4 Any question concerning the legal interpretation of the rules will be based on English law and the Courts of England and Wales will have exclusive jurisdiction unless you live in another part of the UK, in which case your local courts will have jurisdiction.
